Class Action Brought Against Gateway |
On October 6, 2007, Gateway introduced the Gateway XHD3000 30-inch LCD monitor (“XHD3000”). The XHD3000 was advertised as a state-of-the-art monitor that would provide a high-resolution display and many years of reliable service to videogame players and other persons who needed, and were willing to pay a premium for, a high-end display monitor.
The complaint in this class action case alleges that the named plaintiff bought the premium monitor for $1,638.75 but experienced sub-par performance. The complaint alleges the display produced abnormal visual artifacts and would not perform as represented. Problems alleged to have been experienced by the named plaintiff and numerous other purchasers of the monitor include flickering images, green tint over the entire screen, vertical multicolor lines, green lines, blanking, severe banding, screen flutter, side button issues, blackouts, red flickering lines, and complete screen failures.
The complaint alleges Gateway technical and customer support failed to provide a resolution to the problems experienced by users of the monitor.
The complaint alleges the XHD3000 was defective in its inception and design, and incapable of performing as represented. The case seeks damages and relief for a nationwide class of persons who purchased the monitor. |
